Booking Terms and Conditions.
Terms and Conditions: AUDI SOUTH AFRICA Driving Experience (“DRIVING EXPERIENCE”)
The DRIVING EXPERIENCE is offered by AUDI SOUTH AFRICA a division of Volkswagen of South Africa (Pty) Ltd (“AUDI SOUTH AFRICA”). Participation in the DRIVING EXPERIENCE shall be subject to the following terms and conditions: -
1. Booking confirmation:
1.1. DRIVING EXPERIENCE booking will be done on the website www.experience.audi.co.za.
1.2. booking can only be confirmed once the payment has been made and the participant/s has completed all the mandatory details required and accepted the terms and conditions.
2. Booking Date:
2.1. A participant may amend the booking date up to 3 working days prior to the DRIVING EXPERIENCE on the website (www.experience.audi.co.za). Should the participant have extenuating circumstances in less than three ( 3 ) working days prior to the event, a written request to amend the booking date must be received on support@audiforum.co.za and the Audi customer support team will evaluate and assist. In the event of a cancellation, the cancellation terms as set out in clause 12 shall apply.
2.2. AUDI SOUTH AFRICA reserves the right to reschedule the booking upon the occurrence of any unforeseen and/or unpredictable circumstances which are beyond the reasonable control of AUDI SOUTH AFRICA, including but not limited to events of force majeure, natural disasters, fires, floods, war, riots, industrial action, acts or omissions of any government authority, machinery damage or breakdown, essential supply difficulties and irremediable non-performance by third parties. In such cases, AUDI SOUTH AFRICA may at its sole discretion, offer the participants alternative DRIVING EXPERIENCE dates or a full refund of the DRIVING EXPERIENCE fee only.
3. Registration Requirements:
3.1. The participant shall be required to, at the time of the DRIVING EXPERIENCE, hold a valid driver’s licence and may not be subject to a driving ban imposed by the relevant authorities.
3.2. The participant shall be required to attend the DRIVING EXPERIENCE briefing at the registration venue and produce his or her original valid driver’s licence at registration prior to the start of the DRIVING EXPERIENCE.
3.3. DRIVING EXPERIENCE briefing times must be strictly adhered to and participants who fail to attend shall not be permitted to participate in the DRIVING EXPERIENCE.
3.4. The DRIVING EXPERIENCE fee will be forfeited in the event of failure to:
a. produce a valid original driver’s licence.
b. attend the mandatory briefing session.
c. participate in or pass the breathalyser test.
d. adhere to the instructions from the instructor.
e. Adhere to the cancellation terms and conditions.
f. Attend the DRVING EXPERIENCE on the date of the booking.
3.5. The participants agree that re-bookings shall only be permitted upon receipt of payment for the new booking.
4. Payment requirements
4.1. The cost of the DRIVING EXPERIENCE fee shall be paid to AUDI SOUTH AFRICA immediately on booking the DRIVING EXPERIENCE through the website www.experience.audi.co.za
4.2. The participant will make use of the payment gateway on the website www.experience.audi.co.za.
4.3. A successful payment will be shown on screen for the participant and a booking confirmation email will be received by the participant.
4.4. Tax invoices will be added to the booking confirmation email.
4.5. Unsuccessful payment will be notified and reflected on the website.
4.6. In the event that payment has not been made as aforesaid, the participant shall not be entitled to participate in the DRIVING EXPERIENCE.
5. Purchased Vouchers
5.1. Vouchers may be bought through the website www.experience.audi.co.za.
5.2. Available dates of the event can be selected when redeeming the voucher.
5.3. The recipient of a voucher must logon to the website www.experience.audi.co.za and complete the necessary booking process.
5.4. The unique voucher code will be used during the payment process and can only be used once.
5.5. Vouchers purchased through the website will expire three (3) years from the date of issue.
5.6. Vouchers cannot be exchanged for cash.
5.7. Purchased vouchers may be transferred provided that the recipient complies with the DRIVING EXPERIENCE terms and conditions and
5.8. The onus to timeously redeem the voucher shall rest on the recipient of the voucher. Failure to timeously redeem the voucher will result in forfeiture.
6. Complimentary vouchers
6.1. All new RS customers will be eligible for a complimentary AUDI DRIVING EXPERIENCE voucher.
6.2. The participant will have a period of two (2) years to redeem the complimentary RS AUDI DRIVING EXPERIENCE voucher from the date of issue.
6.3. Complimentary vouchers are non- transferrable. Exceptions may be granted at the sole discretion of AUDI SOUTH AFRICA and need to be requested via email to support@audiforum.co.za
6.4. AUDI DRIVING EXPERIENCE venues are limited and at the selection of the appropriate venue is at the sole discretion of AUDI SOUTH AFRICA.
6.5. The onus to timeously redeem the voucher shall rest on the RS Customer. Failure to claim the complimentary voucher timeously will result in forfeiture.
7. Own risk:
7.1. The participant voluntarily participates in the DRIVING EXPERIENCE and is aware of the risks, dangers and perils associated with any form of motoring event.
7.2. The participant participates in the DRIVING EXPERIENCE entirely at his or her own risk.
7.3. Vehicle allocation is subject to the fleet that is on hand and is in AUDI SOUTH AFRICA’s sole and absolute discretion.
8. Marketing Consent
8.1. The Participant consents to be captured/filmed/ photographed/recorded by AUDI SOUTH AFRICA for marketing material at the DRIVING EXPERIENCE.
8.2. The participant consents to the use of the captured marketing material for marketing purposes by AUDI SOUTH AFRICA and/or their third-party marketing and public relations agencies.
8.3. The participant understands that AUDI SOUTH AFRICA shall be entitled to edit any contributions as it sees fit, in its sole discretion. The participant shall not be entitled to payment for any visuals used in the marketing material.
8.4. The participant understands that AUDI SOUTH AFRICA shall be entitled to edit any contributions as it sees fit, in its sole discretion. The participant shall not be entitled to payment for any visuals used in the marketing material.
8.5. The participant consents to the ongoing internal and external publication of the marketing material which may involve personal data (without compensation) l by AUDI SOUTH AFRICA and/or its third-party marketing and public relations agencies.
8.6. The Participants is advised that the publication on AUDI SOUTH AFRICA’S Intranet and/ or Internet pages may involve cross-border transfer of personal data.
8.7. The participant confirms that the marketing consent has been granted on free will and not under any duress or in any form of threat.
8.8. AUDI SOUTH AFRICA confirms to adhere to the applicable data protection regulatory requirements.
8.9. The participant may withdraw consent at any time by emailing AUDI SOUTH AFRICA.
8.10. The participant confirms that the onus shall rest on the participant to withdraw consent and notify AUDI SOUTH AFRICA.
9. Liability
9.1. The participant assumes liability for:
a. The full extent of the loss or damage (including consequential loss) suffered by AUDI SOUTH AFRICA arising from the participant’s non- adherence to the DRIVING EXPERIENCE instructions, use of the vehicle for any purpose other than that for which it is loaned, contravention of the terms and conditions or any applicable legislation.
b. Any costs for medical treatment should it become necessary during the participation in the DRIVING EXPERIENCE.
10. Indemnity:
10.1. By participating in the DRIVING EXPERIENCE, the participant indemnifies AUDI SOUTH AFRICA, its Directors, employees, agents, property owners of venues and/ or service providers against any and all liabilities, loss or damage (including consequential loss) arising from:
a. The participation in the DRIVING EXPERIENCE.
b. Failure to adhere to the briefing instructions and the Instructor.
c. Non- adherence to the DRIVING EXPERIENCE terms and conditions.
11. Conduct:
11.1 The participant shall be obliged to behave with utmost discipline during the attendance of the DRIVING EXPERIENCE. The instructors and/or any person authorised to do so by AUDI SOUTH AFRICA shall be required and entitled to give instructions to the participant for the entire duration of the DRIVING EXPERIENCE.
11.2 The participant authorises the attending paramedic to proceed with any necessary medical treatment should it become necessary during the participation of the AUDI DRIVING EXPERIENCE. The participant acknowledges that he/ she shall be responsible for the payment of any medical costs incurred.
11.3 No spectators or guests will be allowed at the event.
12. Cancellation terms:
12.1. The participant may elect to cancel the DRIVING EXPERIENCE booking after the purchase of the DRIVING EXPERIENCE.
12.2. In the event of a cancellation, the following time limits shall apply, and cancellation fees shall be due and payable by the participant as follows:
a. Full refund if the participant cancels more than seven (7) calendar days before the event.
b. No refund if the participant cancels less than seven (7) calendar days before the event.
12.3. Refunds of the applicable amount and are set out in clause 13.
12.4. The time limits set out above refer to the time of receipt of the written cancellation by AUDI SOUTH AFRICA.
12.5. Cancellation must be made by the participant on the website www.experience.audi.co.za.
12.6. AUDI SOUTH AFRICA shall be entitled to offset the cancellation fee payable against payment of DRIVING EXPERIENCE fees already made by the participant.
12.7. If applicable, the DRIVING EXPERIENCE fee, alternatively the balance thereof, shall be reimbursed to the participant.
13. Refunds
13.1. Once AUDI SOUTH AFRICA has been notified of your cancellation of the booked DRIVING EXPERIENCE through the website www.experience.audi.co.za and AUDI SOUTH AFRICA has accepted the cancellation, a refund will be processed within 5 – 7 working days of acceptance of the cancellation.
13.2. Refunds are manually processed through AUDI SOUTH AFRICA. Once your cancellation has been received, our Customer Interaction Centre will contact you for the bank details for the refund.
13.3. Refund amounts will be calculated according to the cancelation terms laid out in clause 12.
13.4. Refunds may also be subject to deductions for bank charges, credit card charges or other necessary costs incurred by AUDI SOUTH AFRICA.
14. Data Protection
14.1. The processing of your personal information is necessary to carry out actions for the conclusion and performance of this DRIVING EXPERIENCE booking, to which you are a party. The personal information collected for this purpose includes:
a. Name
b. Surname
c. Identity and/or Passport Number
d Telephone Number
e. E-mail Address
14.2. AUDI SOUTH AFRICA does not sell your information to third parties. AUDI SOUTH AFRICA may from time to time disclose and jointly process customer information with its agents, dealer partners, holding company and affiliates including, but not limited to, Volkswagen Aktiengesellschaft in Germany and Volkswagen Financial Services of South Africa.
14.3. You have a right to access any of your personal information that AUDI SOUTH AFRICA holds and make corrections if necessary and the right to object to the processing of your personal information. You also have the right to withdraw any consent that you have previously given to AUDI SOUTH AFRICA and ask AUDI SOUTH AFRICA to erase or delete your personal information that is held. AUDI SOUTH AFRICA shall have a right to continue to process your information where a legitimate purpose exists.
14.4. Should you be dissatisfied with the manner in which your personal information is being processed and wish to lodge a complaint you may do so with either AUDI SOUTH AFRICA’s Information Officer at info.officer@vwsa.co.za or alternatively with the Information Regulator. 14.5. AUDI SOUTH AFRICA conducts surveys to improve their service and product offerings and may occasionally contact you to request your participation. You may withdraw your consent to the processing of your personal information for this purpose at any time.
15. Warranties
15.1. The participant warrants that he/ she:
a. read the terms and conditions of the AUDI DRIVING EXPERIENCE, and
b. is in good health and has no medical condition which may be aggravated by participation in the AUDI DRIVING EXPERIENCE.
Acceptance: The participant understands and accepts the above conditions and will comply with the terms and conditions set out above.
